Hemp Is Under Attack

If we don't act by November 12th, 2026, all hemp products with even trace amounts of THC will be made illegal and considered a Schedule I drug on par with heroin.

Help Us Stop the Hemp Ban!

We need Congress to extend the effective date of this legislation another two years to give us more time to fight for robust regulation over mean-spirited prohibition. Use the form linked below to tell your U.S. Senators and Representative: extend the hemp moratorium and protect American hemp.

Statement from Kim

Hi Friends, Congress recently inserted language into a government funding bill that will outlaw the hemp products our customers rely on, including every product Soberish sells.

The ban takes effect on November 12, 2026. That means every THC product we make, every drop, every gummy, every shot, will be illegal next year unless Congress fixes the problem it caused.

If Congress doesn't act, our business and tens of thousands of other family farms, manufacturers, retailers, and employees will be forced to shut down.

The wellness alternatives millions of Americans use to sleep better, drink less, and feel like themselves again will disappear from the market.

We are not giving up. We've been preparing for this fight for over a year. Use the link below to fill out a digital form to show your support for hemp.

I usually have three glasses of wine before bedtime so I can fall asleep. The calories started to add up and so did my weight. I thought I would give these drops a try. Feeling skeptical as they surely wouldn’t replace my wine. Surprise!! They not only have improved my sleep but i actually lost two pounds over two weeks just omitting my nightly wine. Thank you Soberish.

Frequently asked question

Any hemp-derived product containing more than 0.4 milligrams of total THC per container will be illegal under federal law. That's per container — not per serving, not per dose. Most full-spectrum CBD oils, hemp gummies, hemp seltzers, and hemp tinctures sold today exceed that threshold by 10–100x. Soberish products do too.

Yes. Every Soberish product on this website is federally compliant and legal to ship to your door until November 12, 2026. If you've been meaning to stock up, this is the year to do it.

Soberish isn't going anywhere. We've been preparing for this fight for over a year, including developing a full line of new wellness products that aren't affected by this law. We're not promising we can stop the ban — but we are promising we'll keep showing up for the community we built this for, no matter what Congress does.

It was. The 2018 Farm Bill — championed by Senator Mitch McConnell — made hemp federally legal. Seven years later, McConnell led the effort to reverse it by burying ban language inside a must-pass government funding bill during the November 2025 federal shutdown. There was no standalone vote, no committee debate, no public hearing. It just became law.

That's the argument supporters use. The problem is the law doesn't restrict sales to minors, require child-resistant packaging, mandate testing, or impose any age verification — it just bans the products outright. If Congress wanted to protect kids, smart regulation could pass tomorrow and the industry would help write it. We support that. What we don't support is banning a $28 billion legal market overwhelmingly used by adults over 35 instead of fixing the actual problem.

The Data Shows Connection to Hemp Wellness
